2 – Consent to the collection, storage, use, disclosure and destruction of personal information
2.1 – General consent
Consent by an individual to the collection, storage, use, disclosure and destruction of personal information may be given explicitly or implicitly. By using the www.bresse.com website or any linked domain, or by signing the Consent form (downloadable by clicking on the link), you consent to this Policy and to the various terms and conditions set out herein concerning the collection, storage, use, disclosure and destruction of your personal information.
2.2 – Right to withdraw consent
At any time, you may withdraw your consent to the disclosure or use of your personal information by contacting the Information Officer listed in section 1.
3 – Personal information
- The Policy deals with the notion of “personal information”. This notion includes any information about a natural person that directly or indirectly allows that person to be identified, which may include, but is not limited to:

- Resume information such as current employment, education, work history, professional affiliations;

4 – Safety measures implemented by Bresse
Bresse has implemented security measures to ensure the protection of personal information that is collected, stored, used, disclosed, retained or destroyed in a manner that is reasonable given the sensitivity of the information, the purpose for which it is to be used, its quantity, distribution and medium. To this end, the following measures have been put in place:
- Use of a server protected by software to detect and prevent illicit intrusions;
- Limit access to files containing personal information to employees whose duties justify such access;
- Protective measures for files stored in physical form;
- Raising employee awareness through presentations on risks involving personal information, and committing them to implementing work methods that respect a high degree of confidentiality;
- Use of lock systems on electronic devices and software to access personal information;
- The obligation for any employee of Bresse and third parties to whom personal information has been disclosed to report any event suggesting that a security incident (involuntary or unauthorized disclosure of personal information, unauthorized access to personal information, etc.) has occurred to the Information Officer; and
- The creation of a personal information incident register.
Despite all the measures put in place by Bresse, no method is infallible and there is always a risk of an incident involving personal information. We are therefore unable to guarantee the absolute security of personal information transmitted to us. 5 – Purposes for which personal information is collected :
Personal information is collected by Bresse for the following purposes:
5.1 – Information gathered on the Internet
5.1.1 – Information collected by cookies
Information collected through cookies is used for marketing purposes. These are used to build up a profile of users of the www.bresse.com website and any related domain (the Website), so as to be able to target them when setting up advertising campaigns on the Internet. Bresse uses personal information such as geographic location, interests, age, gender, device used, search engine and channel of entry to the Website to deploy advertising campaigns.
5.1.2 – Information collected in the “list registration” section of the Website
The information provided in the ” Listings ” section of the Website is collected for the purpose of sharing assets for sale by Bresse.
5.1.3 – Information collected in the “Make an Appointment” section of the Website
The information provided in the ” Make an Appointment ” section is collected for the purpose of contacting applicants to offer them Bresse services. The information collected is also retained by Bresse’s marketing manager for statistical purposes.
5.2 – Information collected in person, by telephone, by videoconference, by e-mail, by letter or by any other means of communication
5.2.1 – Information gathered during the period preceding the submission of a file
The information gathered in person, by telephone, by videoconference, by e-mail, by letter or by any other means of communication during the period preceding the filing of a file under the Bankruptcy and Insolvency Act is used to analyze the various solutions available to the person consulting us. By gathering this information, Bresse is able to assess the financial situation of the person concerned and provide solutions to his or her indebtedness.
5.2.2 – Information collected during the administration of proceedings filed under the Bankruptcy and Insolvency Act
Information collected in person, by telephone, by videoconference, by e-mail, by letter or by any other means of communication during the administration of a proceeding filed under the Bankruptcy and Insolvency Act is used to update information required under any legislation and to administer the file in general. In fact, by collecting information, Bresse complies with its various legal obligations.
5.2.3 – Information gathered during a bidding or sales process
Personal information collected by Bresse during a bidding or sale process is used to sell the assets concerned. This information is used to evaluate the quality of offers and to obtain the opinion of creditors or inspectors, as the case may be.
5.3 – Information collected in any other context
Personal information collected in any other context is intended for the operation of a licensed insolvency trustee business, including, without limiting the scope of the foregoing, the administration of Bresse’s files, computer management, compliance, marketing and accounting.
6 – Communication of personal information to third parties
6.1 – As part of the performance of a service contract or mandate
Bresse may disclose personal information to its service providers in connection with the performance of a service contract or mandate required to carry out its activities. In such cases, the mandate or contract is given in writing and stipulates the obligation of the co-contractor or agent to respect high standards of personal information protection and retention, and to use the personal information only in the performance of its mandate or contract.
This type of communication will occur, for example, in the context of an IT service contract (advertising, data hosting, etc.), an insurance contract, in the context of an asset sale, or in the context of a legal mandate entrusted to a lawyer.
6.2 – Government authorities, regulatory bodies and other professional organizations
Bresse may disclose personal information to government authorities, regulators and other professional bodies, including the Office of the Superintendent of Bankruptcy and the Official Receiver, when required by law.
6.3 – To Bresse employees
Information collected by one Bresse employee may be communicated to any other Bresse employee whose duties require the use of such information.
7 – Retention of personal information
Personal information is retained only as long as necessary for the fulfillment of the purposes for which it was collected, subject to legislative and professional requirements providing for certain retention periods.
8 – An individual’s right to personal information about him or herself
8.1 – Right of access to personal information
Upon written request to the Information Officer whose coordinates appear in section 1 and within a reasonable time, a person may obtain confirmation of the existence of personal information concerning him or her, a communication of this information as well as a copy. Where personal information is computerized, this request may also include the provision of a written and intelligible transcription.
Access to personal information is free of charge. However, a reasonable fee will be charged for any transcription, reproduction or transmission of such information.
8.2 – Correction of personal information
Upon written request to the Information Officer, whose contact information appears in section 1, and within a reasonable period of time, an individual may obtain the rectification of personal information concerning him or her if it is inaccurate, incomplete, equivocal or if its collection, communication or retention is not authorized by law.

8.4 – Commission for access to information
Anyone has the right to file a complaint with the Commission d’accès à l’information.
9 – Update
Bresse reserves the right to modify this Policy at any time. When the Policy is modified, it becomes effective at the time it is posted on the Website. Your continued interaction with Bresse following the posting of a revised Policy will mean that you accept the changes.
