Jonathan’s construction company

"Thanks to Émile and his team. I was taken in hand the same evening I contacted the Bresse team. In barely an hour, Martin streamlined the problem and clearly explained my possible solutions." Jonathan

The situation

For the past eight years, Jonathan has been running a construction company renowned in the region for the quality and reliability of its projects. As an RBQ-licensed general contractor, he is directly responsible for the financial stability of his company and its ability to continue operating.

Recently, his team was working on a major project that would ensure the company’s financial stability for several months. Initial payments from the client were made without a hitch, and Jonathan managed his site with rigor.

Halfway through the project, however, the situation took a turn for the worse: the client began to delay payments, citing unjustified defects. Unpaid invoices began to pile up, and the lack of cash quickly put Jonathan in an untenable position. Unable to pay his subcontractors, he was forced to demobilize the site, hoping to find a solution before the situation worsened.

A week later, he receives a demand letter, and shortly afterwards, a lawsuit for several hundred thousand dollars. With no funds to cover the legal costs, he realized that the survival of his company was at stake.

His accountant, aware of the seriousness of the situation, recommended that he consult BRESSE to evaluate the various options available to protect his business, his RBQ license and his professional assets.

The objectives

– Avoid the costs and stress of a civil trial;
– Avoid bankruptcy and the loss of your RBQ license; and
– Pay off your debts.

The solution

Accompanied by his advisor Martin at BRESSE, Jonathan decided to file a proposal to restructure his company’s debts and avoid bankruptcy. An initial offer is submitted to creditors, proposing payment of 30% of total debts over 60 months. This would enable Jonathan to immediately suspend the current legal proceedings, while continuing to run his business.

During this period, Martin took charge of negotiations with the main creditors, including the principal behind the lawsuit.

The result

After discussions, the parties agreed to a final settlement of 40% of the debt, spread over 60 monthly payments. The proposal was accepted by the majority of creditors, putting an end to the lawsuit and the financial pressure on the company. Jonathan was able to avoid bankruptcy and protect his RBQ license.
